Mac Tools Class Action Lawsuit takes on a Life of its own! The Mac Tools Lawsuit has taked on a life of it's own. Because of overwelming response the Class Action has a new home. Class Action! After five years of punching these Corporate Hooligans in the belly, the day has come. The day that I have always said that Stanley would rue. On September 20, 2004 at 2:51pm, a Class Action lawsuit was filed in the Northern District of Ohio against The Stanley Works and American Express on behalf of screwed distributors everywhere. This lawsuit can be accessed here. You can access all of the available pleadings in the panel to the right. $15 Million Defamation / Trademark Infringement Lawsuit Turns 5 Years Old and is promptly Dropped by Stanley! The now famous $15 million lawsuit Stanley filed against me for these websites has been dropped by Stanley. What started as a strong-arm tactic to stop me from blowing the whistle on these corporate crooks turned into a miserable failure for the corporate goon squad. Not only were they unable to shut down these sites or shut me up, but the word spread further and faster because of it. The rules of court in Canada say that the case has to move forward within 5 years and if it does not, than the court will dismiss it. Here is a copy of the Affidavit I sworn in support of dismissing this action. After I swore the affidavit Stanley 'dropped' their case. This case has not seen any movement in well over 5 years and it is now before the courts requesting it be dismissed. They will no doubt argue against it, but there is no denying that this case has remained dormant for half of a decade. The court is obliged to dismiss it with costs and I look forward to this chapter of this war come to an end. Will they sue me again for something else? You can bet on it. Will it frighten me in any way? No a chance.
Mac Tools Suck Dot Com is part of the most comprehensive corporate whistle blowing project ever undertaken on the World Wide Web. Dedicated to uncovering the evil doings of corporate menace, The Stanley Works, this website and it's siblings have educated untold masses about the nasty trappings of America's oldest tool manufacturer. As a Mac Tools distributor, I was defrauded by Stanley Works. I took it upon myself to seek compensation through the courts, but was stifled not by the law, but by a team of less than honest shysters. My case has yet to go in front of a Judge (after more than 5 years) and in frustration, Mac Tools Suck Dot Com and the Stanley Sucks Network were born. Once my story was posted on the Net, Stanley began a campaign to get rid of me, most notably a $15 million lawsuit. Once the Mac Tools fraud was posted on the Net (and Stanley unsuccessfully tried to shut me down) the truth started to emerge. I knew I was not the only one, but never could have guessed the extent to which the fraud had permeated the mobile tool industry. Within a year of the launch of my Anti Mac/Stanley websites in 1999, I learned of several hundred other traditional dealers who had sued them. I was not alone. I was not the only one who Mac stole from. After being sued by hundreds of traditional dealers who had been bilked by Mac in the early to mid nineties, Mac was forced to try to stem the tide of lawsuits. About 1/3 of their distributors had put forth legal claims and newly appointed CEO of Stanley, John Trani, decided to get away from contract dealers and instead hire employees. Mac Direct was introduced in mid 1997 and was met with trepidation and anger by most of us traditional dealers. At the time we were experiencing extreme backorder issues and other operational problems because of the rework of Stanley under John Trani's leadership. Mac Direct was implemented to keep the distributor force from imploding. Anyone who knew Mac Tools from the inside knew that the problems that were persisting in the Mac business model could not be fixed by simply changing the methods of distribution. The problems were deep rooted and soon became apparent when Stanley tried to run Mac direct with the same problems that caused traditional dealers to sue them hundreds of times. Mac Direct was destined to fail and like so many Mac Tools initiatives before, has died a slow, painful and expensive death. On April 9th, 2003 Stanley finally threw in the towel and put the MDSR program out of its misery. After sinking hundreds of millions of dollars into the program they are now abandoning it in favor of the same system that caused them the problems to begin with. In an information package sent to the remaining MDSRs, Mac made an offer to the distributors for them to convert to traditional dealers. They gave them 48hours to decide to convert and receive a discount on the value of their truck, inventory and accounts all without benefit of an audit. Bad credit? No problem, they will carry just about anyone. Under capitalized? No worries! Mac will be there for you. Just like the hundreds and hundreds of Mac dealers who have sued them or the AES program class action lawsuit they settled from their last failure. Mac's fraudulent position that the new traditional program is going to save Mac is both ridiculous and criminal. Once again, there will be hundreds of middle class families believing a bill of goods sold to them by a company with a nasty past, who will lose their shirt. This time around, there is a resource that will help them. This time, there is Mac Tools Suck Dot Com. Currently there are new cases in California and many others being prepared across the U.S. on behalf of distributors who converted to traditional distributors (and were ripped off) as well as a class action that will be filed on behalf of MDSRs. I have assisted many dealers in the U.S. and Canada to receive compensation from Mac Tools and have worked closely with the best consultants and lawyers in the industry.
